Welcome to Cumulo, an AI companion experience developed and operated by Galaxion Limited (“Cumulo,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of the Cumulo mobile application, website, and related services (collectively, the “Services”).
By creating an account or using our Services, you agree to these Terms. If you do not agree, please do not use Cumulo.

1. Eligibility

You must be at least 13 years old (or 16 where required by law) to use Cumulo.
By using the Services, you confirm that you meet the minimum age requirement and are legally capable of entering a binding agreement.

If you use the Services on behalf of another individual or organization, you represent that you have authority to bind that party to these Terms.

2. Account Registration

To use Cumulo, you must create an account with accurate and complete information, including your name, email address, and a secure password.

You are responsible for:

• Keeping your account credentials confidential

• All activities under your account

• Promptly notifying us at elainezhou@cumuloai.com if you suspect unauthorized access

We may suspend or terminate your account if we detect suspicious activity or a violation of these Terms.

3. Use of the Services

Cumulo is designed to offer interactive, emotionally intelligent AI companionship and reflection features.
By using the Services, you agree to:

• Use Cumulo only for lawful, personal, and non-commercial purposes

• Refrain from posting or transmitting any unlawful, harmful, or offensive content

• Not interfere with, reverse engineer, or exploit the Services for unauthorized purposes

• Respect the emotional and creative community environment within Cumulo

We may monitor or moderate certain activity to ensure compliance but are not obligated to do so.

4. AI-Generated Content

Cumulo uses artificial intelligence to generate conversational responses, emotional reflections, and journal entries (“AI Content”).

You understand and agree that:

• AI Content is automatically generated and may not always be factual or accurate

• Cumulo is not a substitute for medical, therapeutic, or professional advice

• You are responsible for how you interpret and use AI Content

• Galaxion Limited may use de-identified interaction data to improve and train its AI systems

If you encounter inaccurate or unsafe content, please report it to elainezhou@cumuloai.com.

5. Microphone, Camera, and Photo Access

Certain Cumulo features require access to your device’s hardware:

• Microphone — Used for voice chat and emotional tone detection

• Camera / Photos — Used for “cloud-sharing,” daily photo tasks, or customizing your Cumulo

You can control these permissions in your device settings.
If you disable access, some features may not function.

By enabling access, you grant Cumulo limited permission to process your voice or image data only for delivering the requested features.

6. Subscription and Payments

Cumulo only offers paid experiences.
If you purchase a Cumulo subscription or other in-app items:

• Payments are processed securely through third-party platforms (e.g., Apple App Store, Google Play, Stripe)

• Subscriptions renew automatically unless cancelled before renewal

• Cancellation and refund policies are governed by your app-store provider

• Prices and features may change; we will notify you of any significant updates

7. Ownership and Intellectual Property

All content, designs, software, and AI systems within Cumulo are the intellectual property of Galaxion Limited or its licensors.

You retain ownership of content you upload (text, audio, or photos), but grant us a limited, worldwide, royalty-free, non-exclusive license to use, process, and display that content solely for operating and improving the Services.

You may not copy, reproduce, modify, or distribute Cumulo’s materials without our written permission.

8. Community and User Content

Cumulo may include features that allow users to share photos, reflections, or other creative content (“User Content”) with the community.

By sharing User Content, you agree that:

• You own or have permission to share it

• It does not violate laws or others’ rights

• You grant Cumulo a limited right to display it within the app or related media

• Public posts may be visible to other users

We reserve the right to remove content that violates these Terms or community standards.

9. Privacy

Your privacy is important to us.
Please read our Privacy Policy to understand how we collect, use, and protect your personal data, including microphone and photo information.

By using Cumulo, you consent to the processing of your data as described in that policy.

10. Termination

You may delete your account at any time by contacting support@cumulo.app.

We may suspend or terminate your access if:

• You breach these Terms

• You misuse the Services or harm other users

• We are required to do so by law or technical reasons

Upon termination, your right to use Cumulo immediately ceases.
Certain data may be retained as required by law or for legitimate operational reasons.

11. Disclaimers

Cumulo provides emotional companionship and self-reflection tools, not therapy or medical care.
The Services and AI Content are provided “as is” and “as available,” without warranties of any kind.

To the fullest extent permitted by law, Galaxion Limited disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, reliability, and accuracy.

12. Limitation of Liability

To the maximum extent allowed by law:

• Galaxion Limited, its officers, employees, and affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of Cumulo.

• In no event will our total liability exceed the amount you paid (if any) for the use of the Services in the twelve months prior to the claim.

If you are in emotional distress or crisis, please seek help from a qualified professional or local emergency service.

13. Indemnification

You agree to indemnify and hold harmless Galaxion Limited, its affiliates, and employees from any claims, damages, or losses resulting from:

• Your use or misuse of the Services

• Your violation of these Terms

• Your shared or uploaded content

14. Changes to These Terms

We may update these Terms occasionally.
If significant changes occur, we will notify you in-app or via email before they take effect.
Your continued use after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-laws rules.

Any disputes arising from or relating to these Terms or the Services shall be resolved:

• First, through good-faith informal discussions; and

• If unresolved, by binding arbitration under the rules of the American Arbitration Association (“AAA”), held in California, unless prohibited by local law.

You agree to waive any right to participate in class-action lawsuits or class-wide arbitration.
